Finally, President Kenyatta's ICC case deferred to February 2014


The International Criminal Court, through its Trial Chamber V(b), has postponed the commencement of Presidentt Kenyatta's case from the early scheduled date, November 12, to 5th of February 2014.

The Judges sitting in the Trial Chambers decided to defer the cases facing President Kenyatta after noting that both the Prosecutor and the Defence team were in agreement on the defering the trial date until early next year.

President Kenyatta's Defence team had requested the Chamber, on 24th of October 2013, to put off the initial commncement date.

The Prosecution, on the other side, accepted jthe request noting that certain factual which wetre raised by the Defence warranted further investigations and submitted that they too be allowed more time in order to present more evidence and in a logical and coherent sequence.

However, while making its ruling, the Trial Chambers regreted the case had to be deferred to next year but noted that it was for the interest of justice and fairness to both parties in the case. They also based their ruling on the common ground of both the Prosecution as well as the Defence teams asking for more time to prepare.

The Chamber asked both parties to accelerate their preparations to make sure that they will not require any more postponement.
