
A Nairobi High Court heard how Alice Mugwe, 27, killed her son, 5-years-old Peter Mugo by pushing him down a pit latrine in Lari on June 26th , 2009, following constant marital differences with her husband after he discovered she had lied to him that she had no child when they started living as man and wife.
This was after they had happily lived together for almost one year before the problems started. The court heard that it is at this point that the woman hatched the plan to get rid of the hapless Peter Mugo.
according to witnesses, Alice visited her mother's homestead and lied that she was to travel with the kid to Naivasha for a few days. The child's body was later found in a pit latrine and that is when villagers suspected she was behind the gruesome murder.
Three days later, the villagers descended on the woman and demanded to know what had happened to the little boy and they beat her senselessly after she denied her involvement in the murder.
She was however saved from the jaws of death by police officers attached to Tigoni police station and was rushed to Tigoni Health Centre and later transferred to Kiambu District Hospital where she was admitted.
It is while at the hospital that Alice Mugwe confessed to one of her sisters that she had resolved to kill her son because she was afraid her husband, David Njoroge would leave her.
On behalf of the accused, lawyer Kanyiri Muriuki asked the court to pardon his client pointing out that she was not in her senses when was killing her deaf and dumb son. He also added that Alice had learnt her lesson the hard way for the period of four years that she has been in custody.
But Justice Nicholas Ombija of the High Court said she must suffer custodial punishment for killing an innocent child with the selfish intention of “stabilizing her marriage” and sent her to jail for six years.
