Nine perish in yet another Ntulele road carnage

The wreckage of a matatu after it collided head on with an oncoming bus at Ntulele along the Narok-Nairobi highway killing 9 people on the spot.

Nine people lost their lives Thursday afternoon in a grisly road accident after a Nissan matatu they were traveling in rammed into an oncoming bus near the Ntulele black spot where a bus killed more than 41 people in August 29, 2013.

The matatu, a Bomet liner, was ferrying passengers from Ntulele shopping centre after it collided head on with a Transline Company bus  traveling from Kisii to Nairobi at the Pinyiny Hills. All the  casualties were in the Nissan matatu.

According to Narok OCPD Peterson Maelo, the 3:30pm accident happened after the matatu burst its rear tyre, hit the guard rail and bounced back to the road colliding with the bus.

“It’s then that the bus that was also accelerating downhill from the opposite direction hit it, killing all the occupants of the small vehicle on the spot,” said Mr Maelo.

“The driver of the bus has been taken to hospital, together with a few of his passengers with minor injuries. It is sad,” said Mr Maelo.
Passengers aboard the Transline bus did not sustain any injuries save for the driver of the bus who sustained serious injuries and was immediately rushed to the Narok District Hospital.

The black spot is about 5 kilometers from Ntulele shopping centre and 15 kilometers from Narok town.

The bodies were taken to to Narok district hospital mortuary.

ICC clears two new witnesses, one a mungiki insider, to testify against President Uhuru Kenyatta

The International Criminal Court sitting at the Hague has allowed the prosecution to bring on board two more witnesses to testify in the case facing President Uhuru Kenyatta. One of the witnesses is said to be a former Mungiki adherent.

The other new entrant is a gender violence expert.

The trial chambers judges however, denied President Kenyatta legal team the requested they had made asking for a postponement of the case facing their client for at least a period of four months should the new witnesses be allowed to take the stand.

The judges reminded Kenyatta's defence team that the prosecutor had promised to use the witnesses after January next year, that is 2014.

The Mungiki insider is only referred to as witness P548 while his gender based violence expert counterpart is known as witness P66. It is however, agreed that the two witnesses will bring new dimensions in the cases facing President Uhuru Kenyatta.

“The Chamber is persuaded from P-548’s witness statements and the prosecution’s submissions that much of the proposed evidence of P-548... brings to light previously unknown facts, which have a significant bearing on the case and would be of relevance in determining the questions at issue in this case,”  the chamber said while making their ruling regarding the mungiki insider.

As for the sexual violence expert, the judges agreed with the prosecution that it was a replacement of another witness, P-426, who withdrew from the case under unexplained circumstances.

“The Chamber is satisfied that Witness 426’s withdrawal means that P-66’s proposed evidence brings to light otherwise unknown facts, which have a significant bearing upon the case. Further, given the overlap P-66’s proposed evidence has with that of former Witness 426, the Chamber considers that the Defence has previously had an opportunity to prepare for similar evidence in this case,” they ruled.

The judges also directed the prosecution team to disclose the identity of he two witnesses to President Uhuru's defence team.

“The Chamber orders the prosecution to disclose the identities of Witnesses 548 and 66 and all disclosable information relating to them forthwith and directs the prosecution to call Witnesses 548 and 66 among the last witnesses of the prosecution case,” they ruled.

Exposed: The famous Teacher Wanjiku caught up in a love triangle affair

The arguably top East African female comedian, Churchill Show's Teacher Wanjiku has been caught in the middle of a love triangle affair involving her, Heartstring's Victor Ber and another woman.

However, Victor Ber has come out guns blazing defending his relationship with  Caro famously known asTeacher Wanjiku.

While denying allegations that his relationship with the female comedian played a big part in his break up with the other woman, who now has his kid, Victor said the woman knew of his relationship with teacher Wanjiku long before she came into the picture.

“First it is not true that Caro (Teacher Wanjiku) ‘stole’ me from someone, either close or otherwise as alleged by some quarters. There was a mutual covenant, which was disregarded by some of the parties involved,” Victor said.

“We have been together, and in love, for the past six years — before I got into a sort of mistake that made the other woman in my life become pregnant, the consequence was the affair that came into place because of the innocent young one,” he remarked.
“The other lady knew of Caro and my undying relationship to her during this period.
“One day, we had a serious talk that looked into this scenario soberly. This was the first of the times that the reality of ‘leaving’ her alone without me abandoning fatherly duties occurred,” Victor revealed.

Terming Teacher Wanjiku as a great artiste, wife and friend, Victor claimed that some forces within the local comedy world were out to ‘kill’ the love affair.

President Uhuru's Mashujaa day speech

SPEECH BY H.E. UHURU KENYATTA, C.G.H., PRESIDENT AND COMMANDER-IN-CHIEF OF THE DEFENCE FORCES OF THE REPUBLIC OF KENYA DURING THE FOURTH MASHUJAA DAY, 20TH OCTOBER, 2013, NYAYO STADIUM

Fellow Kenyans,
It gives me pleasure to join you on this occasion of the Fourth Mashujaa Day celebrations. Before I proceed, I request that we all stand up and observe a minute of silence in honor of all those who lost their lives in the Westgate terror attack.

Thank you.

Let us always cherish their memory.

Fellow Kenyans,
This year, we mark the Golden Jubilee of our Republic. We intend to commemorate 50 years of independence, by celebrating our triumphs and reflecting upon our future progress. We want to remember where we have come from, and envision our journey forward. Starting today, we will have diverse activities by people in all sectors of our public life and all parts of the country to mark “Kenya at 50″. I encourage all Kenyans to join in this festival and celebrate our country.

We are here to commemorate the sacrifice and heroism of many Kenyans whose vision and conviction won us freedom and sovereignty. Colonialism had stripped all Kenyans of their fundamental rights. They had no land, and were considered inferior in their own home. There was neither dignity nor freedom for Kenyans then. Our forefathers waged a struggle of conviction and principle, supported with no resources except the burning fire of humiliation and the indefeasible yearning for independence and respect.

They were brave and noble.
Many took up armed struggle in the forests, as others formed and led movements for the civil agitation for independence. The colonial reaction was repressive and brutal. Heroes were killed and imprisoned, while the rest were stigmatised and hunted down like animals. The cost of the struggle was painful, because the settlers did not consider Africans equal human beings worthy of rights.
This day marks the official beginning of the worst phase of colonialism, and the most harrowing period of our struggle for independence.

The brutality our independence heroes underwent from 20th October, 1952 until the attainment of self-government ten years later defies imagination. It is the reason that we have reverently emblazoned our national flag with the red of their sacred blood. That is why our constitution states that We the People honour those who heroically struggled to bring freedom and justice to our land. In history, Mashujaa Day is a day written in blood by the hand of our heroes.

From an era of racial discrimination and violent abuse, our heroes gallantly ushered us into a new dawn of equality, dignity and sovereignty.

It is important to recognize that the struggle for freedom and justice continued after independence to this day. We are here to salute the unshakable courage, conviction and sacrifice of all those who have served the cause of freedom in Kenya, and in Africa.

Our forefathers rejected colonialism and imperial domination in their time. We must honour their legacy, and stay true to our heritage, by rejecting all forms of domination and manipulation in our time. Let us confront without flinching those external forces seeking to thwart our collective aspirations. They may be powerful and rich, but so were the colonists. They may disrespect and even hate us; we have defeated their ilk before. The struggle to defend our independence is a daily calling for all Kenyans, and all the people of Africa.

Fellow Kenyans,
Besides freedom fighters and political leaders, there are other Kenyans who have made significant contribution in business, research, scholarship, and public service. We commend them for their distinguished service. Most importantly, I would like to commend the millions of Kenyan workers, entrepreneurs, and farmers for their steady nation building efforts. Our country grows and thrives because of your consistency and hard work. You are the practitioners of a unique form of patriotism.
Let us also honour those Kenyans who, every day, perform acts of selflessness and bravery. They include the volunteers who respond in disasters and emergencies, the philanthropists who donate to the needy and members of our security services who protect us at great risk to their own lives. On my own behalf, and on behalf of the people of Kenya, I say a big “Thank You” to all of you.

I also honour our gallant sons and daughters who continue to put Kenya on the world map. Our sports men and women continue to put Kenya ahead of many nations. Our team to the recent World Athletics Championships in Moscow won a total of 12 medals. Through the team’s effort, Kenya was ranked 4th overall and emerged first in Africa. We congratulate the entire team and management for this commendable feat. Moreover, in the past few weeks, Kenyans have secured memorable wins in marathon races across the world. I also wish to appreciate our national Rugby and women’s volleyball teams, and other sports teams who have brought glory to Kenya in various events. The dedication and resilience of our sportsmen and women are a source of pride to all Kenyans. Hongera!

Fellow Kenyans,
Our heroes remind us everyday that we are a nation of winners.
Because our gallant freedom fighters won, we celebrate the freedom, dignity and progress that we have won because of them. They bestowed us with a legacy that we must honour with all our lives. We cherish our nationhood, heritage and the splendor of Kenya in commemoration of the struggles and sacrifices made by our freedom fighters. We must always do them proud.

First of all, we must protect our country from all threats to the national fabric. We have withstood terrible violations by terrorists who have attacked our people and caused much grief and suffering. There have been numerous domestic acts of criminality on worrying scales. My Government is vigilant, and is investing in equipping the security forces to have sufficient capacity to deter and contain all forms of violence and criminality. We want to be a country at peace with itself, and with its neighbours. From time to time, therefore, we may be required to intervene externally to keep our country, and our neighbours safe. We have not been found wanting in that regard, and we stand ready to act whenever required.

I am happy to report that peace and security initiatives in Somalia and South Sudan are bearing fruit.
But security is the shared mandate of all people living in Kenya. The first rule of security is vigilance: we must know everything and everyone around us. It will be a great betrayal for anyone of us to pretend oblivion while next door, someone is assembling bombs, hoarding illegal weapons, or detaining a kidnapped child. That is why we must all embrace the ‘Nyumba Kumi’ plan: ensure that you know at least 10 households around your residence well.
Let us do all we can to protect our country, our people and our prosperity. In doing so, let us realize the holistic scope of our security threats and work on each accordingly. Similarly, I urge Kenyans to be vigilant against vandals and poachers, who selfishly destroy taxpayers’
investment in national infrastructure and our natural heritage. I direct the police to ensure that such people are arrested and prosecuted at once.

We must also grow our economy and develop all parts of the country with the objective of securing a better life and more happiness for all our people. As my Government executes the Second Medium Term Plan of Vision 2030, we are also doing everything we can in the short term that the cost of living is bearable to all Kenyans. We will ensure that undue barriers to affordability of basic commodities are eliminated.

Moreover, my Government has put in place incentives to ensure that producers make Kenya food-secure in the shortest time. Those unscrupulous traders who hike prices, especially of farm inputs as well as produce, under the pretext of VAT are criminals and will be dealt with as such. I direct the relevant Government agencies to remain vigilant against such mischief at all times.
As I have pledged before, my Government is fully committed to the implementation of the Constitution. I want every Kenyan to travel with us on this journey to entrench constitutional freedoms, full implementation of Devolution and the observance of integrity in public institutions.

Even as we do so, I urge those responsible to ensure that the observance of maximum constitutional freedoms does not undermine the public interest in national security and proper management of public property. It is a question of considering all legitimate interests in interpreting and applying the Constitution.

On this day, therefore, I beseech the people of Kenya to be more united than ever before, and to recognise shared opportunities as well as common threats.

Our past has many instances where Kenyans, who are brothers and sisters, have been incited and manipulated to turn against each other on irrational ethnic and religious grounds. As a result, lives have been lost, property destroyed and people displaced from their homes. These incidents shame all of us as a nation, and defile the memory of our heroes. We must never allow anyone, or anything to divide us. Just as we reject domination, we must also reject division and discord.

The Jubilee Government is committed to break from this dark, backward, and dangerous past. As we clearly stated in our manifesto, “we believe in one Kenya; a Kenya where every citizen, whoever they are, wherever they live, will have the same opportunity to succeed and prosper free of discrimination-open or hidden. Our shared aim is to end ethnic tensions and rivalry and to unite all our citizens. We stand for an inclusive Government committed in word and deed to the people it serves. We will actively seek to promote policies that make our people more cohesive and create opportunities for all.” This remains our firm commitment. One Kenya. One People. One Nation.
My Government is doing everything in its power to transform our society to enable every individual actualize their full potential. We will wholeheartedly observe our constitutional responsibility to promote national unity, eliminate all forms of discrimination and marginalization.

Already, we have made important strides in this regard through equitable appointments in the Cabinet and Public service. We have also resettled all internally displaced persons and are doing all we can to enable them integrate back into society. Most importantly, we have provided the opportunity for youth, women, and persons living with disability to thrive as entrepreneurs. I call upon all leaders and wananchi across the country to promote national cohesion, both in word and in deed.

Fellow Kenyans,
In conclusion, I ask that when history looks at us in future, we shall not be found wanting. As I said earlier, we have come a long way, and we are going places. Pamoja twasonga mbele. Therefore, I implore you in the name of our heroes: Let all and one arise and, with hearts both strong and true, endeavour to honestly serve our Homeland. Let us stand firm to defend our heritage and splendor.
With one accord, and united in a common bond, let us build this nation.

Let a glorious Kenya be the fruit of our collective labour, which will fill all Kenyan hearts with thanksgiving.

Finally, let me take this opportunity to wish all candidates success in their national examinations which start this month with Kenya Certificate of Secondary Education.

Thank you.
God bless you, and God bless Kenya.

It has been revealed that several civil society groups are planning to stage mass actions around the country to cause civil unrest as soon as President Uhuru Kenyatta leaves to attend his trial at the Hague based International Criminal Court.

According to the Kieni Member of Parliament Kanini Kega, the civil societies are funded by a number of foreign embassies in the country.

He also sensationally claimed that the groups are already on the ground mobilizing Kenyans to come out and demonstrate as from 12th November when the President is expected to leave the country. This he says, is in a move to cause civil unrest in a bid to render the country ungovernable.

The Member of Parliament further claimed that the protest are planned to be even more worse should the President fail to attend his trials at the Hague.

He also noted that the NGOs are busy working behind the scenes to stage 'nationwide civil disobedience' if President Uhuru decides to honor his date with the International Criminal Court, at the Hague.

The MP called on the leader of majority in parliament, Adan Duale, to take the matter seriously and report to the August house for necessary actions to be taken since that is an issue of national importance.

New CCTV footage from the Westgate Mall shows how four terrorists killed, maimed innocent civilians

CCTV footage obtained from the Wetsgate Shopping Mall, now shows how four terrorists mercilessly shot at innocent people who were running their normal errands on that ordinary Saturday, killing more than seventy while critically injuring many.

The footage also tends to point to the conclusion that there were only four gunmen who attacked the Westage Mall on that fateful day.

The terrorists are also seen, on the footage, conducting their deadly mission in a more relaxed manner, even taking some time of their attacks to pray.

In the graphic as well as frightening video, the gunmen are captured spraying bullets on people who trying to either take cover or running for safety.

Seconds before the attack, shoppers and workers at the shopping mall, are selling and buying but things changes drastically. Men, Women and children are seen scampering for safety after gunshots are heard from outside the mall. Moments later, four gunmen enters and starts starts shooting at anybody in their site.

In what was at first thought of being a mere robbery, the terrorists are also seen talking on phone, in what is believed they were communicating to the outside world.

Uhuru/Ruto are the worst leaders Kenya has ever had, says Citizen TV’s and renowned radio personality Waweru Mburu

Citizen TV's political analyst and renowned radio personality Waweru Mburu, thinks the Uhuru/Ruto government is the worst that Kenyans have ever had for a long time. He also sympathizes with Kenyans for choosing two ICC suspects as their President and his Deputy.

The critical radio personality, on Wednesday, termed President Uhuru and his Deputy William Ruto as 'selfish leaders', who were only after the presidency in order to shelter themselves from their personal problems with the International Criminal Court (ICC).

While referring to the AU summit that took place in Ethiopia, Waweru Mburu noted that the Uhuru/Ruto government has no Kenyans interests at heart, only there 'to perpetuate impunity'. This he says, was evident when President Uhuru Kenyatta took the stand, discussing his personal problems with the ICC only and not the welfare of Kenyans and the country as a whole.

The ever critical Waweru Mburu went further to claim that the two ICC indictees have made Kenya more of a 'laughing stock' in front of the international community, thanks to their cases at the The Hague based ICC.

He concluded by saying, "I agree Uhuru Kenyatta is my President but I always feel ashamed to say so".

The Village Market confirms ownership of the 'satanic' cargo impounded at the port of Mombasa

Satanic
The Market Masters Ltd, a company which runs the Village Market has confirmed the ownership of the strange cargo that was impounded at the port of Mombasa a few days ago, and was linked to a local politician initially.

At first, the KRA officials at the port linked that 'satanic' cargo to a one time assistant minister Omingo Magara. But Mr. Magara came out guns blazing to deny these allegations. He went ahead to give KRA seven days to apologise for this, failure to which he’ll move to court to seek compensation for damages.

Meanwhile, the Village Market came forward to claim ownership of the halloween items. In a press statement, the company revealed that they are to be used to decorate the Village Market during Halloween later this month.

Part of the statement read;
Market Masters LTD, hereby confirms that indeed we have ordered for the Halloween decorative items imported from China in container number PCIU 8125750, and are not restricted items.

Just like during Easter Holiday or Christmas season, the items in question are solely used for decorating the entire shopping centre for our annual Halloween parties held within village market every last Saturday in October, for the past 17 years.

We needed to replace the old worn out ones with us, in readiness for our upcoming Halloween party slated for 26th October 2013.

This brings to an end speculations that have been going round as to who owns this satanic costumes.

NTV's Mark Masai Reveals He Is An Adopted Child

NTV prime time news anchor, Mark Masai, has revealed that he grew up as an adopted child. He also revealed that he was born a muslim, Abdullahi Masai, a name he would later change.
Speaking to QFM's Rashid Abdalla, Mark revealed that his mother, Fatuma Abdullahi, gave him up for adoption soon after birth. Apparently, she felt she was not ready to bear the burden of raising a child at the time.

Mary Wright, a British missionary based in Narok, became Masai's mother. Wright however left the country in 2001, leaving behind Mark and his brother.

The anchor also revealed that he has never met his biological father. He recalled confronting his mother about his identity, while in high school.
The mum was however not ready to reveal to Mark, but promised to do so when the time was right. The 'right time' came one day, just before he read the 4 o'clock news. The mum informed him that she had given his father his contacts, and he would be calling soon.

Mark, all of a sudden, found himself not knowing what to say to a man he had not known for 27 years.

On his adoption, the anchor says he understands his mother's act was in his best interest. - See more at: http://www.nairobiwire.com/2013/10/ntvs-mark-masai-reveals-he-is-adopted.html#sthash.ajVpLVYA.dpuf

Makueni Governor Prof Kivutha Kibwana set to tender his resignation

Makueni Governor Professor Kivutha Kibwana is expected to tender his resignation today, 15th October, 2013, a move that will see his Deputy Adelina Ndeto Mwau become the first woman governor in Kenya.

Kibwana who had gone out of the country for treatment said, he will officially tender his resignation to speaker of the MCA following a budgetary stalemate between him and the members of his county assembly.

Top county officials have also accused him of misappropriation of funds in the county and that is seen as one of the reasons why Kibwana is opting to resign.

"I have decided that I am not able to be of help to the people of Makueni in this matter. After I leave hospital, I will tomorrow offer a letter of resignation as governor of Makueni County Government. I thank you for the privilege of serving you since March 27, 2013," Kibwana said in a post to the Makueni County Sharing Forum on the Facebook.

Kibwana had allocated the MCA Sh89 million for its operation out of his 5 billion budget. He then later revised the amount upwards to Sh554 million, an amount the MCA did not want to hear either. They demanded a minimum of Sh601 million.

Meanwhile, Makueni senator Mutula Kilonzo Junior said he had not received any official communication over Kinbwana's intended resignation.

Article 182 section 2 states that if the governor’s office falls vacant as a result of death, resignation, conviction of a crime of the office holder, ineligibility of election as a governor, or is removed from office under the constitution, the deputy governor assumes the office of the governor for the remainder of the 5-year term.

That is the law that will see Adelina Ndeto become first woman Governor in the country if Prof Kivutha Kibwana makes good his intention to resign.

Fatou Bensouda rubbishes AU's attempts to shield President Uhuru Kenyatta from attending his trial at the ICC

The International Criminal Court chief prosecutor Fatou Bensouda, has downplayed African Union's attempts to shield President Uhuru Kenyatta from attending his trial at the Hague based court, saying suppose he fails, she will issue an arrest warrant against him.

In a statement sent to newsrooms immediately after the AU passed its resolution in Ethiopia on Saturday, Bensouda reiterated that President Uhuru has a case to answer on murder and rape charges and must cooperate with the ICC.

She also said ICC being an international court, will not be cowed by 'selfish' African leaders who are passing resolutions trying to threaten the court.

On Saturday, 12th October, 2013, African Union leaders unanimously passed a resolution barring President Uhuru Kenyatta from attending trials at the ICC.

The African leaders threatened to fully implement that resolution if the United Nations security Council will not agree to defer the cases facing President Uhuru and his Deputy William Ruto at the ICC.

Meanwhile, the third witness in the Deputy President's case is expected to take the stand this week at the ICC.

KRA officials impounds bizarre cargo at the port of Mobasa, links it to a prominent politician

Fear and socked struck the port of Mombasa and the country in general in equal measure when the Kenya Revenue Authority officials impounded on a container carrying several weird looking masks, trophies and implements.

The port official said the cargo was imported from China and linked it to a senior unnamed politician in  the country.

Meanwhile, the fake skulls, limbs and skeletons have sparked different opinions and thought from different quarters with some analysts saying that is merely a diversionary to conceal some other cargo while others strongly believe and have associated the cargo with evil forces.

The KRA is said to have launched investigations to unravel the link the bizarre cargo and the politician.

Mungiki supported Raila Odinga in the 2007 general election, ICC told

The International Criminal Court at the Hague, was yesterday told that Raila Odinga enjoyed substantial support from the outlawed Mungiki sect in the run up to the 2007 general elections.

The court also heard that Raila Odinga, then a presidential candidate, gave Maina Njenga, a leader of the outlawed group, two fictional books on war when he visited him in prison before the 2007 elections.

While cross examining witness No326 Deputy President William Ruto's lead lawyer Karim Khan, informed the court that the former Prime Minister Raila Odinga gave Maine Njenga two books, The 48 Laws of Power by Robert Greene and The Art of War by Sun Tsu at Kamiti maximum prison.

Mr. Khan was seeking to convince the ICC court that if Mungiki took part in the 2007/08 Post Election Violence, then they had Maina and Raila's blessings to count on.

Meanwhile, the witness appeared calm, collected and responded to Khan's questions even as he tried to link ODM's Raila Odinga with Mungiki during the 2007 general election.

Big blow to ICC prosecutor Fatou Bensouda as witness 326 disconnects Ruto from the 2007/08 PEV

The International Criminal Court prosecutor Fatou Bensouda suffered a rather big blow, which could have serious implications on her case against the Deputy President William Ruto after one of the prosecution witnesses, witness No326, took a different angle from her's on the nature of the 2007/08 Post Election Violence.

The witness, in a cross examination by William Ruto's lead counsel Karim Khan, termed the post poll chaos as spontaneous contrary to the prosecution's stand that it was well planned and executed by William Ruto among other big political names in the country.

The witness No326 told the ICC court that the violence broke immediately after the former President Mwai Kibaki was declared winner over ODM's Raila Odinga in unclear circumstances.

He also noted that supporters of both ODM and PNU had camped at the KICC awaiting the final results only for heavily armed police to take away the then chairman of the defunct ECK the late Samuel Kivuitu to an undisclosed room within the building where he declared Mwai Kibaki the President.

In his opinion, it is the circumstances under which Mwai Kibaki was announced president after the 2007 general election that sparked violence which later spread spontaneously to other parts of the country where many people lost their lives and properties.

The witness also told the ICC judges that there is no one person who had time to plan the 2007/08 Post Election Violence, not even William Ruto as the prosecution led by Fatou Bensouda claims.

The testimony of witness 326 could weaken the prosecution's case against the Deputy President William Ruto.

High Court Judge Francis Gikonyo writes to Tobiko to arrest and prosecute Moses Wetangula

Former Bungoma Senator Moses Wetangula's woes seems to be far from over, particularly after Bungoma High Court Judge Francis Gikonyo wrote to the Director of Public Prosecutions Keriako Tobiko wanting him to arrest and subsequently prosecute the former senator over electoral malpractices.

In a letter dated September 30th, the High Court judge says Moses Wetangula committed an electoral for what he termed as 'treating voters' during the March 4th general elections.

He also noted that he stripped Wetangula of his senatorial seat after he found him culpable of electoral malpractices and asked the office of the DPP to open criminal charges against him.

This comes a big blow to Wetangule since he will not be able to contest again in the by election that expected to come in the near future.

Some members of the CORD coalition have already branded this a 'jubilee plot' to lock out Moses Wetangula in the by election.

Meanwhile, Wetangula who was the only member of the three CORD's principals to sit in either parliament or senate, faces up to five years in prison if in any case found guilty.

ICC witness 326 was an ODM member (from luo Nyanza) -connects Raila/Nyong'o to 2007-08 PEV killings

The second International Criminal Court (ICC) witness testifying in the case against Deputy President William Ruto took to the podium, where he accused former Prime Minister Raila Odinga and ODM Secretary General Professor Anyang' Nyong'o as among those who bankrolled the 2007/08 Post Election Violence.

In his testimony which started at around midday on Monday, witness 326 who is alleged to be an ODM party member and worked briefly at Orange house, Kilimani (near Yaya Centre) explained how Orange Democratic Movement financed and bankrolled youths who slaughtered people during the 2007/08 Post Election Violence.

He said five leaders of ODM, (Pentagon) planned th eviolence of 2007-08. He named Raila Odinga, Musalia Mudavadi, Joseph Nyaga, William Ruto, Najib Balala and Charity Ngilu.

This came as Ruto's lawyer Karim Khan strongly protested the hiding of names of top ODM officials who will be mentioned by the second witness who was testifying in public.

The witness 326 is an ODM member from Luo Nyanza.

A class eight pupil at Matangwe Primary School in Bondo District, Siaya County died on Sunday after allegedly being caned by her teacher for failing an examination during the weekend tuition.

According too her classmates, Millicent Obondo pictured above, collapsed a short time after one of their teacher caned her with what they described as a plastic pipe after she failed to reach the 50 per cent pass mark.

“Our teacher came to class and started caning those who had failed to surpass the 50 per cent pass mark. On caning her, she collapsed,” said one of the students.

The pupils then took her outside for first aid but their efforts did not yield any results after which they were forced to rush her to a nearby hospital where she was confirmed dead.

Millicent's family members rushed to the hospital after learning of what had happened to her.

Mrs. Nora Obondo, a guardian to Millicent, said she had been informed of instances of Millicent collapsing in school, although that had never happened at home.

“There is a time when the teachers told me that Millicent had collapsed at school. On inquiring about the incident, I was told that she had collapsed after she had participated in a race,” said Mrs Obondo.

Meanwhile, Jackson Ogweno, the Nyanza Parents Association, called on the government to ensure that proper actions are taken against the teacher once the investigations are done citing that corporal punishment was abolished in schools.

“This is one of the worst forms of negligence that we have experienced in the teaching profession,” said Mr Ogweno.

Sheikh Aboud Rogo's ally Ibrahim Rogo shot dead alongside 3 others

Key ally of the late radical Islamist cleric sheikh Aboud Rogo, sheikh Ibrahim Rogo was killed together with three others yesterday, Thursday night by unknown gunmen in Mombasa.

The four were killed while on their way home from Musa mosque when the assailants sprayed their car with bullets along the Mombasa-Malindi highway. Only one of the five occupants in that vehicle, Salim Aboud, survived the attack.
He had to play dead to save his life.

According to Salim, they just finished preaching at the mosque and they were heading home when a number of assailants on foot started sparying their car with bullets until it veered off the road instantly killing the four.

"We have finished them," Mr Salim Aboud heard them say as he played dead. The gunmen then sped off in a Mark X.

Muslim clerics who arrived at the scene including sheikh Abubakar Sherrif alias Makaburi, pointed fingers at the Anti Terrorism Police Unit.

"The ATPU were here, why have they run way? What are we going to do next and why are they killing us? We have not killed any one but the police are killing innocent Muslims," Mr Makaburi lamemted.

"This actions are being led by Americans and Israelis, Sheikh Ibrahim was not at Westgate during the attack. Western governments do not want Muslims to talk about Jihad. It is part and parcel of Islam, kill us all," he said.

ICC prosecutor now wants the Kenyan government to arrest and hand over Barasa for witness interference

After the International Criminal Court issued a warrant of arrest for journalist Walter Barasa, the prosecution led by Fatou Bensouda is now asking the Kenyan government to arrest and hand him over to the ICC to face charges of interfering with its witnesses.

The ICC prosecutor confirmed that the Kenyan government had officially received a warrant to immediately arrest and transfer Barasa to the ICC in order to face criminal charges.

"There is evidence to suggest that Walter Barasa tried to bribe someone he thought was a Prosecution witness in the case against (Deputy President William) Mr Ruto," said the prosecutor in a statement on Wednesday.

She added that the prosecution has carried out a comprehensive investigation on witness interference and they have enough evidence that there is a network of people who are out to sabotage Deputy President William Ruto case at the Hague based criminal court and the prosecution believes that Barasa is part of this wide network.

"The evidence collected so far indicates that there is a network of people who are trying to sabotage the case against Mr Ruto et al. by interfering with Prosecution witnesses. Walter Barasa, against whom compelling evidence has been collected, has been part of this network, and his actions fit into this wider scheme that the Office continues to investigate," Bensouda said.

Barasa has since refuted these allegations saying the ICC prosecution team is merely after him for refusing to cooperate with them to nail Deputy President William Ruto.

Under the Rome statute, if one is found guilty of witness interference, may be jailed for up to five years, or fined, or both.

Another blow to CORD as Wetangula is ineligible to vie in the Bungoma senatorial by election

The Coalition for Reforms and Democracy on Monday suffered a major setback after one of its three principals Moses Wetangula was stripped of his senatorial seat by a Bungoma High Court citing electoral malpractices.

It is now emerging that CORD is yet to suffer another blow since Wetangula may not be eligible to vie during the by election following the ruling by High Court Judge Francis Gikonyo. The court nullified Wetangula's election on grounds of bribery, intimidation and double registration during the March 4th election.

The court also found Wetangula guilty of committing an election offence contrary to the Elections Act.

The Act states;  "A person who is convicted of an election offence or who is reported guilty of an       election offence by the Election Court shall not be qualified to be nominated for election as an elected member of the National Assembly/Senate, during the remainder of the life of that parliament following his conviction or, as the case may be, following the report"

The High Court slapped Wetangula with a 1 million shillings, which he paid, for bribing voters during the general election.

According to the IEBC, Wetangula is now ineligible to run in any election for a period of the next five years. A senior official at the IEBC said they will disqualify Wetangula from running in the by election on grounds of election malpractices.

All this is happening as word has it that Musikari Kombo who filed the petition, is said to be stepping down for Eugine Wamalwa in order to give CORD a run for their money in the by election.

Former Prime Minister Raila Odinga stole the show on Tuesday at the KICC while addressing the nation during the interdenominational prayers for the Westgate victims and arguably outshone every other speaker who took to the podium to deliver his speech including President Uhuru Kenyatta and his deputy William Ruto.

Raila's speech was full of authority and patriotism which left a majority of the people who attended the event clapping for minutes.

President Uhuru chose rather to give his usual speech which he has been giving since the terror attack.

Speaking at the same event held at the Kenyatta International Conference Centre, Deputy President William Ruto kept repeating the now famous WeAreOne slogan while at the same time reminding the nation of the Jubilee manifesto.

The former Prime Minister on his part, chose to give solutions to nearly all problems and steered clear of the things that needs to be done in order to avert such terror attacks in the future. He also called for unity among Kenyans from all walks of life.

In what looked like an unprecedented move, Raila even took issue with the US for issuing a travel advisory against Kenya.

And all that said and done, it begs the question....is Raila the peoples' President?
