Kethi Kilonzo and her party, the Wiper Democratic movement, have moved to high to sue the Independent Electoral and Boundaries Commission over its ruling that locked her out of the Makueni senatorial race.
The IEBC revoked Kethi's candidature on Monday over allegations that she is not a registered voter as required by law and the Political Parties Act.
In an application filed on Wednesday 10th July, Kethi's lawyers Harun Ndubi and Jullie Soweto, are asking the high court to stop IEBC from gazetting a notice that excluded Kethi's name as a candidate for the Makueni senatorial by election, until the court hears and determines the case.
They also want the court to quash IEBC's cancellation of Kethi's candidature.
On the other hand, they also want Kethi's name to be included in the voters register.
High court judge, Justice Lenaola certified the matter as urgent and set the hearing of the case for Thursday.
